1. Agreement to Terms
By purchasing data leads or subscription-based services from Prexium LLC (“Prexium”), you (“Buyer” or “Client”) agree to the following Terms and Conditions. These terms form a legally binding agreement between the Buyer and Prexium.
2. Scope of Services
Prexium provides high-intent data leads tailored to the criteria agreed upon at the time of purchase. Leads may include contact information, property or demographic data, and other relevant details as outlined in your order or agreement.
3. Permissible Use
The Buyer agrees to:
Use all leads in compliance with applicable local, state, and federal laws, including privacy and marketing regulations.
Not resell, share, or distribute any lead data to third parties without prior written consent from Prexium.
4. Data Accuracy & Limitations
Prexium makes reasonable efforts to ensure the quality and relevance of leads delivered. However, due to the dynamic nature of online submissions and third-party data sources, Prexium does not guarantee that all leads will be accurate, responsive, or result in conversion.
5. Lead Delivery
Leads will be delivered electronically through the client dashboard or a secure delivery method agreed upon in writing. Delivery timelines may vary by product or subscription tier. Please note that it can take up to 60 days to fulfill your order.
6. Refund & Lead Replacement Policy
No Monetary Refunds.
Prexium does not offer monetary refunds for leads or subscriptions. Approved replacement requests will be fulfilled in accordance with this policy.
Eligible for Replacement If:
- Phone numbers provided are invalid or unrecognized
- Contact number is a fax line or consistently routes to an unrelated voicemail
- The property is already listed
- The lead includes an obviously fake name or test submission
- The property is outside the agreed target area
- The address is incorrect or does not exist
- Duplicate leads are received within a 60-day window
Not Eligible for Replacement If:
- The wrong product or lead type was selected
- The lead is unresponsive but the info is accurate
- The prospect declined or changed their mind
- The lead made an error in their submission
- The lead did not result in a closed deal
- The same customer submitted to multiple providers
- The request is submitted more than 4 days after delivery
- No valid documentation is provided
Follow-Up Process Required
To qualify for a lead replacement:
- You must contact the lead within 10 minutes of receipt
- Make at least 9 follow-up attempts in the first 24 hours (3 morning, 3 afternoon, 3 evening)
Submission Requirements
- Submit requests via your account dashboard under “Your Leads”
- Include supporting documentation (e.g., call logs, screenshots, or recordings)
- Requests must be submitted within 4 days of lead delivery
- Replacement volume is limited to 10% of total leads purchased per month
Prexium may contact the lead directly to verify legitimacy before approving a replacement.
7. Subscription & Cancellation Policy
Applies only to subscription-based products and services.
All Prexium subscriptions require a 3-payment minimum. Subscriptions renew on the same day each week or month based on your original sign-up date.
Once the minimum is reached, you may pause, cancel, or modify your subscription via your online account.

8. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary or sensitive information shared throughout the duration of this agreement.
9. Limitation of Liability
Prexium shall not be liable for:
Lost revenue or missed business opportunities due to use or non-use of leads.
Any regulatory penalties or legal action arising from misuse of the data by the Buyer.
Total liability is limited to the amount paid by the Buyer for the relevant leads or subscription period.
10. Termination
Either party may terminate this agreement with ten (10) days’ written notice.
Termination does not release the Buyer from obligations related to previously delivered leads or subscriptions.
11. Indemnification
The Buyer agrees to indemnify and hold harmless Prexium LLC, its employees, agents, and affiliates from any claims or liabilities resulting from improper use of the data leads or violation of applicable laws.
12. Dispute Resolution
Any disputes arising from this agreement shall be settled through binding arbitration in the State of Texas, USA.
The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
13. Governing Law
This agreement shall be governed by the laws of the State of Texas, USA, without regard to conflict of law principles.
14. TCPA Consent
By purchasing leads or submitting your contact information, you expressly consent to being contacted by Prexium LLC and its authorized representatives via:
- SMS (text messages)
- Calls using prerecorded or artificial voice
- Auto-dialing systems
- Email or physical mail
Standard carrier rates may apply. Calls may be recorded for quality and compliance purposes.
15. Privacy & Data Usage
Prexium collects and stores personal data in accordance with its Privacy Policy. You have the right to request, correct, or delete your personal data at any time by contacting support@prexium.com.

17. Changes to Terms
Prexium reserves the right to modify these Terms and Conditions at any time. Changes will be posted to our website, and continued use of our services constitutes acceptance of the revised terms.
